Today, the Executive Office of Housing and Livable Communities officially recorded the final regulations for the home inspection law passed under the Affordable Homes Act last summer.

New Implementation Date: Thanks to advocacy by MAR, the start date has been pushed back from July 15 to October 15, 2025. This gives us more time to prepare, update forms, and educate clients.
New Disclosure Requirement: Sellers will now be required to provide a signed disclosure to buyers, confirming that the buyer has been informed of their 10 day right to inspect the property. This must be signed by both parties before entering into a purchase contract. (sound familiar, lead paint anyone?)
Important Changes from the Draft Rules
- Limited liability under Chapter 93A now only applies if the disclosure form isn’t provided.
- New construction is exempt from the disclosure requirement.
- Licensed home inspectors no longer exempt from the regulations.
- More flexibility for negotiating inspection timing and repair contingencies.
