So, your seller has decided to delay input to the MLS or wants to enter into an Office Exclusive listing…what next?
Delayed Listing: A delayed listing does not get entered into the MLS until the date that your seller has selected and you have entered on the DELAYED LISTING IN THE MARKETING, SHOWING AND MLS ENTRY (Delayed Addendum). The seller agrees that this property will NOT be marketed in any way, and:
(1) There shall be NO showing, by any party, of the Property to prospective purchasers;
(2) There shall be NO public or broker open house/tours held;
(3) There shall be NO display of the Listed Property on any Internet site;
(4) There shall be NO sharing of the Listed Property on social media
(5) There shall be NO placement of a “For Sale” sign on the Listed Property; and
(6) There shall be NO marketing of the Listed Property in any print, electronic or email advertisements.
(7) There shall be NO sharing of information regarding the Property to brokers outside of the listing office until the Active date when it becomes available for all brokers and their clients.
After obtaining your signed Exclusive Right to Sell Contract and Delayed Addendum your next step is to email a copy of both to listings@berkshirerealtors.net within 2-business days of seller’s signature. NOTE: Staff does not know if you have begun entry and left your listing as incomplete. Uploading your ERTS and Delayed Addendum as an attachment to an incomplete listing does NOT satisfy this requirement. When it comes time to make your listing live in the MLS, the list date can be entered as the date that shows on the Delayed Addendum.
Office Exclusive: An office exclusive listing does not get entered into the MLS. Rather, the seller instead directs the broker to solicit interest exclusively from the Brokerage’s network of buyers, and the seller acknowledges that while the property is withheld from the MLS, they will not have access to any of the benefits of the MLS, and:
• Understands that the MLS is the largest, most comprehensive source for sharing property information with other REALTORS® and their buyers in the Berkshire County and surrounding region. Understands that the national average of listings sold by other REALTORS® is 87%.
• Understands that limiting exposure of the property will substantially limit the number of potential, qualified buyers who know that the home is available for sale, and such limitations could impact the offers received.
• Understands that should any party, seller or broker publicly market my property in any manner, broker is obligated to enter the property listing details, with at least one photo, into the MLS.
• Understands that the property will not be included in the MLS broker tour schedule, the public open house schedule and broker-to-broker message board, nor shared with brokers outside of the listing firm. seller(s) further acknowledges and agrees;
• That the decision to withhold the Property from the MLS was solely their decision and initiated by them.
• That the broker is obligated by the Code of Ethics of the National Association of REALTORS® to cooperate and work with other REALTORS® except when cooperation is not in their best interest.
• That the broker has not made an offer of compensation to other brokers in the MLS for securing a buyer for this property. This does not preclude the BROKER from choosing to do so individually, provided the amount of compensation and company policy regarding the payment of compensation, if any, is disclosed to them at the time of entering into the Exclusive Right to Sell Agreement.
After obtaining your signed Exclusive Right to Sell Contract and OFFICE EXCLUSIVE / REFUSAL TO LIST PROPERTY IN MLS your next step is to email a copy of both to listings@berkshirerealtors.net within 2-business days of seller’s signature.
