Closing Disclosure is Privileged

We have received a few calls from area attorneys that there is an emerging issue with brokerages and agents asking for a copy of the closing disclosure at/after closing.  They just want to clarify that this document contains privileged information and sensitive information.  A lawyer is unable to release any information, including the CD, without their client’s consent.  Therefore, a buyer must direct them in writing to provide anyone with that document, or you can obtain it directly from your client if needed.  Just wanted to clarify that restriction and also that if received, it must be protected according to the Massachusetts WISP (written information security protocol) regulations.
