Mandatory Use of CURRENT Exclusive Right to Sell Contract

The MLS Board met and decided that August 15th will be the last date that we will accept OLD Exclusive Right to Sell contracts for submission to the MLS.  Please check that the Exclusive Right to Sell Contracts you are using indicate on the bottom of each page  “Last Revision: 6/2014”.  If old forms are received, your seller will have to re-sign on the new form within 24 hours to keep the listing in the MLS.  For more information on how to find the revised contract in FlexMLS and for a brief update on the changed clause, please see the following.


 What was the last change made?

The  last change was made in June of 2014 with notice disseminated to the membership, and the latest Exclusive Right to Sell Contract made available in FLEX since mid-June.  The Contract and Forms Committee significantly changed the Exclusive Right to Sell agreement in October of last year.  Then, based on considerable feedback and confusion over the listing period change from a fixed # of months to a finite begin and end date, the committee updated the form again.  In June 2014, the final version of the contract now reads:

*Updated Portion of Exclusive Right to Sell Contract: 2. LISTING TERMS: SELLER hereby gives and grants to BROKER, a member of Multiple Listing Service (MLS) of the Berkshire County Board of REALTORS®, Inc., the exclusive right to list and sell the above mentioned Property for the period to begin on the date of the SELLER signature and end on __/__ /__ , unless extended in writing by all parties involved. The list price for the Property shall be of $__________ or at such other price, terms and considerations to which SELLER may agree.

How do you find the Revised Exclusive Right to Sell Contract?

1) Under the Forms Tab in FLEX, select “Blank Forms”. Simply click the “Exclusive Right to Sell Agreement (6/14)” shown within the blue box below. The next screen will allow you to save or print blank copies of the Revised Contract.

2) Under the Forms Tab in FLEX, select “My Forms”. Add a form to an existing folder by selecting the green plus sign (see image below).

Selecting the green plus sign will take you to the next screen: “Add Form(s) to Folder” (see image below). Click on the plus sign to the left of where it says “Seller Agreements” which will drop down a list of all available Seller Agreements to add to your folder. Check off the “Exclusive Right to Sell Agreement (6/14)” (see image below) and click the “Continue” button at the bottom of the page.

(You can, of course, add the new Contract to a new folder as well. Click “Add Folder” at the top right-hand corner, give it a name on the next screen, and click on the plus sign to the left of where it says “Seller Agreements” which will drop down a list of all available Seller Agreements to add to your folder. Check off the “Exclusive Right to Sell Agreement (6/14)” and click the “Continue” button at the bottom of the page.)
