Are they working with an agent already?

Please remember when meeting new buyers and sellers, our Code of Ethics requires that you must make reasonable efforts to determine if they are subject to a current, valid exclusive agreement to provide the same type of real estate service. This obligation is part of the broader duty to protect and promote the interests of clients and to treat all parties honestly. You cannot obligate someone to pay two commissions without making it clear that they understand the ramifications of entering into an agreement with you / your firm. A best practice would be to ask leading questions… Are you working with an agent? Have you seen any property recently?  Have you attended any open houses? If they have signed any type of paperwork, for the term of the agreement and make sure to pursue it further if they don’t know the answer!
