Do you disclose a family member who isn’t related by blood when listing a property in the MLS? Interestingly… It doesn’t say blood relative, it says “family member” in the MLS and Code of Ethics and MAR Disclosure of Conflict. Even Massachusetts state law that talks about your obligations to disclose uses the word KIN… And kin are defined as “family”.
In speaking with the MAR legal hotline, they advise that if you consider somebody your family, then you need to disclose it. Legal counsel always says to err on the side of disclosure. Even to the point where if you consider somebody a family member that is outside of your immediate family that you should still disclose it.
So, disclose, disclose, disclose!!
