What’s the Deal with Refusals?

As of late, there have been quite a few questions regarding submission policies of the Exclusive Right to Sell Contract Addendum- Refusal to List Property in MLS.

When do you send this to the Board Office? Send the Refusal Addendum within 2 business days of the seller(s)’ signatures!

Do I send the Exclusive Right to Sell Contract as well? Yes, send both the Exclusive Right to Sell Contract and the Exclusive Right to Sell Contract Addendum- Refusal to List Property in MLS within 2 business days of the seller(s)’ signatures!

 

As a general Rule of Thumb, any contract or addendum that you are submitting to the Board Office, must be submitted within two business days of the seller(s) signatures. The contracts and addendums must be completed fully and accurately with all signatures obtained and dated.

 

The Board Office will keep the completed contracts on file. If the seller has requested that the Broker Delay Dissemination and Publication, we will verify new listings against the contracts on file once they are published in the MLS. They will be verified to match the Listing Terms of your Exclusive Right to Sell Contract, which means the begin and end dates you enter into the MLS, must match the begin and end dates of your Exclusive Right to Sell Contract.

 

Excerpt from our MLS Policies: Refusal To List or Show Property:

A refusal to list form must be on file with the MLS within two (2) business days of the seller(s)’s signature on an Exclusive Right to Sell contract, in which the owner has requested the property not be advertised throughout the service.

A refusal to list form must be on file with the MLS within two (2) business days of the seller(s)’ signature on an Exclusive Right to Sell contract, in which the owner is not able to show the property.  A property may only be advertised and disseminated in the MLS when cooperating brokers have a right to show and the property can be actively marketed and sold.

In either circumstance, the form must be completed in full, and be signed by the seller(s) and the listing agent.  Further, if the refusal to list reflects a delayed submission date, it is the agent’s responsibility to make sure that the listing is active and submitted to the service on the day indicated.  [Amended May 22, 2013]
