Please check that the Exclusive Right to Sell Contracts you are using says “Last Revision: 6/2014″. We’ve discovered that some members have their contacts and forms folders set up so they continue to reuse old contracts instead of accessing all of the newly updated versions. We have a simple solution and some direction to make sure you are organizing your agreements to be efficient and protected. First, we recommend you organize your contacts in folders by CLIENT or transaction. This is a great way to refer back to agreements that you’ve drafted for a specific individual. It’s also then so easy then to make a change to reflect negotiated terms. It also ensures that every time you add a new form to a client folder, you are accessing the most recent version.
The MLS Board met and decided that August 15th, 2014 was to be the last date that we would accept OLD Exclusive Right to Sell contracts for submission to the MLS. When old forms are received, your seller will have to re-sign on the new form within 24 hours to keep the listing in the MLS. We are still getting Old ERTS Contracts. The forms that you had saved into folders before the change did NOT AUTOMATICALLY UPDATE. I believe the main reason this is happening is because instead of new folders for each client, some are continuing to use one generic, old folder in “My Forms” in flexmls. This is because these forms may have already been in use. Below please find instructions on how to add the new ERTS contract to your existing folders and how to delete the old versions if you wish to do so.
How do you find the Revised Exclusive Right to Sell Contract?
Under the Forms Tab in FLEX, select “My Forms”. Add a form to an existing folder by selecting the green plus sign (see image below).
Selecting the green plus sign will take you to the next screen: “Add Form(s) to Folder” (see image below). Click on the plus sign to the left of where it says “Seller Agreements” which will drop down a list of all available Seller Agreements to add to your folder. Check off the “Exclusive Right to Sell Agreement (6/14)” (see image below) and click the “Continue” button at the bottom of the page.
(You can, of course, add the new Contract to a new folder as well. Click “Add Folder” at the top right-hand corner, give it a name on the next screen, and click on the plus sign to the left of where it says “Seller Agreements” which will drop down a list of all available Seller Agreements to add to your folder. Check off the “Exclusive Right to Sell Agreement (6/14)” and click the “Continue” button at the bottom of the page.)
Old versions of Exclusive Right to Sell Contracts will read “OUTDATED” next to them (see image below). If you wish to delete a contract from your folder, highlight the form you wish to delete in yellow and click the red X under “Actions” to delete the form.
Folder Tip: Create new and unique folders for each new client/listing (i.e. “Smith Listing 123 Street”). Add forms as you go and you will never add an old version because you can’t!
F.Y.I. Blank forms automatically update in FLEX. Under the Forms Tab in FLEX, select “Blank Forms”. Simply click the “Exclusive Right to Sell Agreement (6/14)” shown within the blue box below. The next screen will allow you to save or print blank copies of the Revised Contract.
