Implementation of the new home inspection disclosure law has been delayed to October 15, 2025, following advocacy by MAR. Key improvements have also been made to protect REALTORS® and ensure flexibility in real estate transactions. REALTORS® need to be aware that the regulations include a requirement that sellers provide a signed disclosure to potential buyers that highlights the potential buyer’s right to inspect the property. This disclosure must be signed by both parties prior to entering into a contract to purchase the residential property. MAR will continue to work with EOHLC on the language of that standard disclosure form and to finalize it before the October 15 implementation date.
On June 6, the state posted the finalized regulations implementing the new home inspection law that was included in the Housing Bond Bill in 2024. The regulations will only apply to transactions with contracts entered into after October 15, 2025.

In addition to the extended implementation date, MAR secured several additional improvements to the regulations, thanks in large part to feedback and comments from members. Some of the additional changes include limiting strict 93A liability to the failure of a real estate licensee to provide the required disclosure form, an update to the exemptions to remove a carve out for home inspectors and to include an exemption for new construction. The regulations will also now allow for more flexibility for the parties to negotiate terms relative to the timing of inspections and contingencies based on the estimated cost of repairs.
