Just a friendly reminder that a buyer’s broker may NOT advertise another broker’s listing without their permission … and that includes a post sharing that a listing is pending, without the consent of the listing broker. (MLS Regulations) “Section 2:12 A listing shall not be advertised by any Participant, other than the listing broker, without the prior consent of the listing broker.” The listing broker was hired by the seller to present their home to the public in an agreed manner, so they must drive any marketing or public display of that listing.
After the sale however, you can clearly claim to have sold the property, but you MAY NOT use the listing broker’s photos or text without their consent. The listing firm / agent owns the copyright to the photos and text and you need permission to use them, or must take your own photos for use after sale for marketing. At the same time, you must present a true picture in advertising, marketing, and other representations, meaning you cannot suggest that you listed the property.
By the way, we’ve seen some fantastic pending posts where one agent gives kudos to the other agent on making the successful transaction, but with consent!! Finally, remember that all of your posts must contain your brokerage name, not just your own. It’s the law. Happy marketing!
